Child's picture is being used as avatar on MySpace without permission from parent.?

Please help me find a solution to this problem? This child's photo is being used by father's girlfriend as her avatar on her MySpace page. This, from my vantage point is child endangerment specifically because the girlfriend posts to her friends which do not have "nice" pictures nor phrases on their sites. This is very upsetting and also poses a danger to my granddaughter. Mother has requested this and other photo's be removed but because the father says.."it's ok"...they stay. I've also asked MySpace to please help to no avail. What recourse do we have? Thanks!
